These Terms & Conditions apply to website design, development, hosting and related services provided by FT Web Designs (“I”, “me”, “my” or “FT Web Designs”).
By accepting a quotation, package or proposal and/or making payment for my services, you agree to these Terms & Conditions.
If you are a consumer, nothing in these Terms & Conditions affects your statutory rights.
I provide website design, development, hosting and related services as described in your quotation or chosen package.
Depending on the package purchased, services may include:
Any work outside the agreed package may be subject to an additional charge. I will confirm any additional costs with you before carrying out the work.
A quotation or package price will be provided before work begins.
A contract is formed when you accept the quotation or package and make the required payment, subject to any applicable statutory cancellation rights.
Unless otherwise agreed, payment is required before work begins.
I reserve the right to correct genuine pricing or typographical errors before a contract is formed.
I will discuss your requirements and create the website based on the information and materials you provide.
The initial design will be provided for your approval, and I will make reasonable amendments within the agreed scope.
A basic amendment is a straightforward change that does not materially alter the agreed design, structure, functionality or scope of the website.
Requests for significant design changes, new pages or additional functionality may be treated as additional work and quoted separately.
Once a website has been approved and launched, further changes will be dealt with under the modification allowance included in your package, where applicable.
You are responsible for providing any text, photographs, logos, branding, business information and other materials required for your website, unless otherwise agreed.
You confirm that you have the necessary rights and permissions to use any materials you provide, including that images, logos and other media are free of copyright restriction for use on your website (or that you hold a valid licence).
You are also responsible for ensuring that information supplied for publication is accurate and up to date.
Delays caused by missing information, content, feedback or approvals may affect the project timescale.
Where your package includes annual website modifications, these are intended for basic content changes.

Modifications do not normally include:
Additional work may be quoted separately.
Each individual requested change may count as one modification. Where multiple separate changes are requested together, each change may be counted individually.
Unused basic modifications do not roll over and expire at the end of each annual period.
The number of modifications included in your package is shown on the FT Web Designs website and/or your quotation.
Website hosting is included for the first 12 months, unless otherwise stated in your quotation.
After the initial 12-month period, annual renewal includes website hosting, domain renewal, SSL and ongoing security, at the applicable package price:

I will normally contact you before your renewal date to remind you that renewal is due.
Hosting renewal is not included in the original website design price.
If you choose not to renew, your website may be taken offline once the paid hosting period ends.
Where reasonably possible, I will provide notice before hosting is suspended or terminated because of non-payment.
If you wish to move your website to another hosting provider, I will reasonably cooperate with the transfer. Work outside the original package may be subject to an additional charge.
Where I register or manage a domain on your behalf, the domain will be registered for the period agreed with you.
Where a domain is included in your package, the annual renewal price includes renewal of that domain. If you request additional domains or services outside your package, any additional costs will be explained and agreed before they are incurred.
You are responsible for ensuring that your chosen domain does not infringe the rights of another person or organisation.
Websites may use third-party services, software, plugins, hosting infrastructure or other external systems.
I will take reasonable care when selecting and configuring third-party services, but I cannot guarantee their continued availability, pricing, functionality or security.
Changes or failures affecting third-party services may require additional work.
I am not liable for any loss, damage, cost or expense arising from downtime, outages, slow performance, data loss or other failures of hosting providers, domain registrars, internet services, content delivery networks, email providers or any other third-party service, except where such liability cannot legally be excluded.
You are responsible for the accuracy and legality of information supplied for publication on your website.
You confirm that any text, images, logos, videos, branding or other materials you provide are owned by you or that you have all necessary rights, licences and permissions to use them on the website. You confirm that such materials do not infringe the copyright, trade mark or other rights of any third party.
I am not responsible for checking the copyright or ownership of materials you supply. If a third party makes a claim arising from content or images you provided, you agree that this is your responsibility.
Unless specifically agreed otherwise, you are responsible for ensuring that your website contains any legal information required for your business, such as privacy notices, cookie information, trading information or terms of sale.
I can add information supplied by you, but I do not provide legal advice and cannot guarantee that your website meets every legal or regulatory requirement applicable to your particular business.
Where SEO is included in your package, this refers to the basic SEO setup described in the relevant package or quotation.
SEO does not guarantee a particular position or ranking on Google or any other search engine.
Search engine algorithms and requirements can change, and rankings are outside my control.
I will provide an estimated timescale for your project where possible.
Timescales depend partly on receiving the required content, information, feedback and approvals from you.
I am not responsible for delays caused by circumstances outside my reasonable control or delays in receiving information or approval from you.
If you purchase services as a consumer through distance means, such as online, by email or by telephone, you may have a statutory 14-day cancellation period.
Nothing in these Terms & Conditions removes or restricts statutory cancellation rights.
If you ask me to begin providing services during the cancellation period, I may ask you to expressly confirm that request.
Where permitted by law, if you subsequently cancel after services have begun following your request, I may be entitled to charge a proportionate amount for services already provided.
Where a service has been fully performed following the appropriate request and acknowledgement, your statutory cancellation right may end.
Business customers may have different cancellation rights depending on the agreement and circumstances.

Where a refund is required by law, it will be provided in accordance with the applicable legal requirements.
If a customer cancels outside any applicable statutory cancellation period, whether a refund is available will depend on the circumstances and the terms of the agreement.
Nothing in these Terms & Conditions removes any statutory refund or consumer rights that cannot legally be excluded.
You retain ownership of materials you provide to me, including your business name, logo, photographs and written content, subject to any third-party rights.
Once the website has been fully paid for, you may use the completed website for your business.
FT Web Designs retains ownership of its pre-existing materials, reusable code, frameworks, templates, development methods and other intellectual property that is not created exclusively for you.
Third-party software, fonts, images, plugins and other materials remain subject to their respective licence terms.
Unless you ask me not to before the project is completed, I may display the completed website in my portfolio and use screenshots or a link to the website to promote FT Web Designs.
I will not knowingly disclose confidential business information that is not publicly available.
I will take reasonable steps to maintain the website and hosting services I provide.
Temporary interruptions may occur due to maintenance, hosting issues, security incidents, third-party failures or circumstances outside my reasonable control. I do not guarantee uninterrupted or error-free availability of your website.
I am not liable for any loss of business, profit, data, opportunity or other loss arising from website downtime, suspension, slow performance or unavailability, whether caused by hosting providers, domain issues, maintenance, attacks, technical failure or other causes outside my reasonable control.
Where appropriate, I will take reasonable steps to restore affected services.
You should retain copies of important business information and content supplied to the website.
I will take reasonable measures to maintain the security of websites and hosting services I provide.
However, no website or online service can be guaranteed to be completely secure.
You are responsible for keeping any passwords, login details or other access information confidential.
I will provide my services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
This includes liability for matters such as death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in this section affects your statutory rights as a consumer.
I will not be responsible for failure or delay caused by circumstances reasonably outside my control.
This may include major hosting outages, internet failures, cyber attacks, natural disasters, government action, widespread technical failures or other events that could not reasonably have been prevented.
I will take reasonable steps to minimise the effect of such events and resume services as soon as reasonably possible.
If you are unhappy with any aspect of the service, please contact me so I have an opportunity to investigate and resolve the issue.

I will acknowledge complaints and aim to respond within a reasonable period.
Nothing in this section prevents you from exercising any legal rights available to you.
The Terms & Conditions applying to an existing project or contract will normally be the version provided or incorporated when the relevant service was purchased.
I may update these Terms & Conditions for future purchases or where changes are required by law.
Any material changes to services or pricing will be communicated before they apply to a new purchase or renewal.
These Terms & Conditions are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights a consumer may have to bring proceedings elsewhere.
The quotation, package details, these Terms & Conditions and any specific written agreement between FT Web Designs and the customer together form the agreement for the services.
If there is a conflict between these Terms & Conditions and a specific written quotation agreed with you, the specific written quotation will take precedence for that particular service.
